No! You are the sponsor of her visa and she must marry you and only you or return to her country before the end of 90 days. If she runs off or marries someone else she will be in violation of the visa and will permanently lose status and be deported. The girls all understand this and are not going to accept a visa invitation if they don't think the sponsor is a viable candidate for marriage. Do girls return to Russia after getting married to an American because of homesickness? Very, very rarely. Of course, in the first few months they go through a period of homesickness but they get past it. Arriving in a foreign country, a Russian woman has a lot of problems with language. She has to be used to different customs, traditions and rules. The first few months she definitely won't be working but staying at home. She is not aware if her knowledge and skills are worth anything. However, if she realizes that she can get a good job, you may be surprised. Can I invite her to the U.S. without meeting her in person in her home country first? No. You must have photos taken together in her home country to prove that you met or photoes taken in any other country. The more different pictures together you have , the more easier for you it will be to make the fiancee visa for your Russian bride. You can make the visa for your Russian bride using the services of laywer, but of course it is much more expensive than by any other way. You can buy the kit for about 100 dollars in many places, in the kit you will have forms you need to fill in and recomendation how to fill them. Also, you can use the person who specializes in making visas or fill the form yourself. How long is the visa good for? Three months. If the girl marries you she can stay, otherwise she must return before the 3 months expire. If the girl has a child, does the child also need a visa? No. The child is included on the girl's visa. Can I marry the girl in Russia, not in USA and return back with the Russian wife? Yes, but in this case she must apply as an immigrant (spousal petition) K-3. The fact of the matter is that the K-1 process (fiancee visa) is subject to a quota system, the K-3 process is not... and both are subject to the identical time constraints for processing the filers paperwork. There are a couple of benefits to the K-3 many are not aware of: The K-1 requires the fiancee to wed within 90 days or return to her homeland, so this requires the man to immediately file paperwork for her permanent residence documenting the marriage. If she did not get an exemption travel stamp placed in her passport when she entered the country she cannot travel outside the USA using her Russian passport until she receives her permanent residence paperwork. This has nothing to do with a Green Card. A Green Card requires the filing of a separate document as the Green Card is what is required to work in the USA if one is not a American Citizen. Once the Fiancee and American Citizen are married to obtain both permanent residence and a Green Card there are different forms (each going through a different process independent of the other) that must be filed and these request are not processed simultaneously, since they are independent of one another. A Green Card and Permanent Residence status are mistakenly used interchangeably but they are entirely different in nature and scope. A person can have permanent residence status from a K-1 or K-3 and still not have Green Card status. In most states in the USA in order to obtain a drivers license for example a person must have a Social Security Card. If one has documented permanent residence status this is a simple process as one simply sends a copy of their status when they file a application for a Social Security number. If a person does not have permanent residence status when requesting a drivers license they must go through another documentation and verification process by the States Department Of Motor Vehicles that they are in the USA legally and that process is state dependent. The K-3 process does require the man to provide documentation that he is single or legally divorced, go through the same filing and documentation process a Russian Citizen would to be married within Russia. They must assure the wedding is conducted by a person who is legally authorized and recognized by the Russian authorities and on file within the area the wedding is held then the wedding documentation must be filed and on record within the Russian legal document system so it can be verified later when the K-3 is submitted. This is not as difficult as it might appear to be. A footnote to this is that a Priest or a person representing a Church or Religion may not be legally authorized to perform civil wedding ceremonies for this purpose. They could certainly marry in a church but may need to also do a civil ceremony to assure all the documentation is legally submitted and accepted into the Russian document system such as a court of records. However the advantage of the K-3 for the American Citizen is that once the K-3 is processed his spouse has automatic residence status upon arrival in the USA and he does not need to then file any additional paperwork to the American INS. Nor does she require a exemption authorization to travel stamp if she wants to leave the USA, she can travel immediately. If he wants her to be able to work, then he would need to file for a Green Card work permit after filing for a Social Security number using her permanent residence status in the same process the K-1 requires for a Green Card. A non resident person who does not enter the USA on a K-1 or K-3 wanting Green Card work authorization status goes through a entirely different process since their Visa is neither a K-1 or K-3. The processing of a K-3 is no harder, more expensive nor lengthy in nature, it is just less popular because it is not understood by most Russian ladies nor American men. The key factor is of course to assure the person conducting the wedding is recognized by the Russian authorities, somewhat like a American Justice of the Peace is authorized to do. Then copies of the wedding documentation needs to be notarized and this should be done in both English and Russian. As a footnote for the K-1 process is that the lady entering the USA on a K-1 visa submitted by one specific man for her on her behalf can NOT marry a different American man once in the USA. The American INS has upheld this decision on many occasions since the INS considers it fraudulent. So if a Russian lady marries a different man after arrival here on a K-1 she must return to her homeland and start the process again but in this case there are legal issues between if she could use a K-1 or a K-3 because in the USA we have both Civil and Federal law. Civil law is at the state level and since she married a American in a State she would be considered legally married to him by that state. But the INS would still take the position she has no legal residence status even though she is married to him. How long does it take to obtain K-1 (fiancee visa) or K-3 visas (spousal petition) and how to do it? There are K-1 and K-3 kits a man can find on the Internet for a fee of less than $100 to submit the documentation himself or he can pay someone to fill in the forms for him, yet he will still need to provide all the documentation. It makes no difference if a clerk who understands the forms does this or if one pays a expensive lawyer to do it, they are still filling out the same forms, but it cost a lot more to have a lawyer do it. When it comes to having a K-1 or K-3 expedited no attorney can do that for you, it is not possible as they have no standing within the Federal INS service. Any individual can do the same as any attorney can when it comes to trying to expedite the K-1 or K-3. The only know way to really elevate a persons filing that the INS may react to is for the American man to contact his local Congressman and Senator, then ask them to write a letter requesting a status on the filing using the INS filing number provided when the Regional processing center notified the man their filing was received and they have no additional questions or problems with the filing. Why do the women write in their profile that they want financially secure husbands? Does it mean that they are after your money? IN NO WAY DOES THIS MEAN THAT RUSSIAN WOMEN ARE AFTER YOUR MONEY. Definitely not! However, women have suffered so much in Russia with everyday surviving, they want to make sure it never happens to them and their families again. A Russian wife will stick with you through any turn of fortune, whether you go bankrupt or hit a jackpot. But to consider you a viable possibility, she must be confident that you are not an unemployed hobo. Your good financial standing may impress women at first, but then the other factors will count: you must develop a relationship that works, and this involves mostly emotional factors. I know many cases when a woman refused a guy with a 500K income in favor of an ordinary teacher, because she liked him more personally. From the sidelines it may seem stupid, but I would probably do the same if I were her. |
